Personal Data Processing Disclosure Statement

A summary guide to Turkish data protection compliance and related user rights.

1. Purpose and Scope

Pursuant to the Turkish Personal Data Protection Law No. 6698 ("KVKK"), Monitfx, acting in its capacity as a data controller, considers the protection, processing, and retention of the personal data of our visitors and users in compliance with applicable legislation among its primary responsibilities. This disclosure statement has been prepared to inform you about the purposes for which your personal data is processed, the legal grounds on which it may be transferred, and your rights as a data subject.

2. Processed Personal Data and Collection Methods

Your personal data is collected through communication forms, membership registration pages, complaint submission pages, cookies, and browser analytics systems available on the Platform, by automated or non-automated means, in verbal, written, or electronic environments. The categories of processed data are as follows:

  • Identity and Contact Information: First name, last name, email address, username, and profile photo.
  • Content and Sharing Data: Complaint details, communications conducted within the Platform, reviews and comments regarding brokers, and uploaded evidence files.
  • Transaction and Technical Data: IP address, port information, website access and exit logs, language preferences, device information, and browser information.

3. Purposes and Legal Grounds for Processing Personal Data

Your personal data is processed in accordance with the personal data processing conditions set forth in Articles 5 and 6 of the KVKK based on the following legal grounds:

  • Establishment or Performance of a Contract: For the establishment of the Platform membership agreement and for the provision and management of services offered to members (such as complaint tracking, ratings, etc.).
  • Compliance with Legal Obligations: For fulfilling legal data retention obligations arising from Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed Through Such Publications, as well as other applicable legislation.
  • Legitimate Interest of the Data Controller: For enhancing platform security, preventing fraudulent accounts or manipulative complaints, and analyzing and optimizing service quality.

4. Transfer of Personal Data

Your personal data may be transferred to authorized public institutions and organizations, judicial authorities, or administrative bodies where required by law for the fulfillment of our legal obligations. In addition, for the purpose of resolving complaints, relevant complaint-related information and evidence may be shared with the respective broker representatives only with the explicit consent of the user.

5. Rights of the Data Subject

Pursuant to Article 11 of the KVKK, you have the following rights as a data subject:

  • To learn whether your personal data is being processed and, if so, to request information regarding such processing.
  • To learn the purpose of processing your personal data and whether it is being used in accordance with that purpose.
  • To know the third parties to whom your personal data has been transferred, either domestically or abroad.
  • To request the correction of incomplete or inaccurate personal data and to request its deletion where applicable.
  • To request compensation for damages incurred due to the unlawful processing of your personal data.

As a data subject, you may submit your requests in writing via support@monitfx.com. Your applications will be processed free of charge and concluded within a maximum period of 30 days.
